1. ACCEPTANCE :
   

The acceptance of this quotation includes the acceptance of the following terms 
and conditions.

Order accepted is subject to the conditions of sale herein specified.

Typographic and clerical errors are subject to corrections.
 

2. PRICE
   

The price quoted in our letter is  exclusive of sales tax, excise duty and any other tax/levies which are/may be imposed by the Central/State/Local self government from time to time.

Whenever we quote F.O.R. rate, we do not charge packing and forwarding charges and the freight is paid by us up to the destination. We are not responsible to pay entry tax, octroi, miscellaneous transportation charges, demurrage and other local charges.

In case of Government legislations or for any unforeseen reason, if the cost of products increases substantially, the company shall be free to revise the rates from time to time without any notice.
 

3. PACKING & FORWARDING :
   
   
@ 1% of unit cost.

Material shall be supplied in 50 kgs. Packing in tin container, covered with wooden box.
 
4. SALES TAX :
   
1. C.S.T.: 4 % ( or prevailing rate ) Central Sales Tax shall be charged in case "C"/"D" form is given by you.  Otherwise G.S.T. at prevailing rate will be recovered.
   
2. G.S.T.: 12% (or prevailing rate ) shall be charged. No G.S.T. will be charged in case Form No. "19" is given by you.
    
5. EXCISE DUTY :
   
   
At present 16% excise duty shall be charged extra.
 
6. INSURANCE :
   
   
If required at your cost.   Goods are dispatched at purchaser’s risk during transit.
 

7. TERM OF PAYMENT :
   
   

The document shall be negotiated for collection of full value of our invoice through a scheduled bank, which you shall immediately retire on presentation failing which interest @ 18% shall be charged for the time it remains unpaid.

The bank charges/ commission/interest etc. if any, in collecting the payment shall be on purchaser’s account or

The terms of payment as fixed by the Company from time shall be applicable.
 

8. DELAY IN RECEIPT OF DOCUMENT :
   
   

The Company will accept no responsibility for delay in receipt or non-receipt of the railway receipt/lorry receipts and documents either through postal or bank and any warfare/ demurrage incurred will be on account of and payable by the purchaser.
 
9. TRANSIT RISK :
   

The Company’s risk and responsibility will cease on delivery of the goods to the carrier by taking out clean R/RS/GC notes thereof at the loading railway station of works site. Any loss of shortage of goods, which may occur during the transit, will be on purchaser’s account. The quantity (number of boxes container) showed in the railway receipt/GC notes shall be accepted and binding on both the parties.
 

10. CLAIM :
    

Claims of complaints, if any, with regard of shortage, damage or of any other nature must be made directly with the railway/carriers. Complaints, if with regard to quality should be lodged with the Company within 15 days from the date of receipt of the goods otherwise the same will not be entertained and treated as no complaints.
 

11. DISPUTES & JURISDICTION :
    

All disputes must be referred to Company’s Registered Office only. No legal proceedings shall be taken to enforce any claim and no suit arising out of contract shall be instated except in court of competent Jurisdiction located within the municipal limits of Rajkot (Gujarat).
 

12. FORCE MAJOR CLAUSE :
    

The offer is subject to usual force major clause.

13. VALIDITY :
    
    The offer is valid for acceptance within 15 days from the date of issue of our quotation, thereafter subject to our confirmation in writing.

    The Company also reserves the right of incorporating other terms while accepting the order.

    While placing order, you will kindly intimate/send us the following:

    a.  Name and address of your banker.
    
    b.  If you require insurance of goods please furnish name and postal/telegraphic
         address of the Insurance Company along with phone No./Fax No./E-mail
         address.
    
    c.   Road permit/import permit, or any other permit required as per state or local,
          semi government laws.
